The CFPB hasn’t been shy about throwing its weight around, and the media are taking notice. I had an opportunity to talk about what the CFPB has been up to recently and whether it’s overreaching on “The Willis Report” on Fox Business. One interesting question came up about whether the CFPB might get involved in litigation over the Federal Reserve Board’s final rule on “swipe fees” for debit card transactions. I also discussed the database of consumer information that the CFPB is compiling, purportedly to understand the mortgage market. The interview also touched on the CFPB’s penchant for pursuing aggressive enforcement actions, rather than telling financial institutions what they can expect through the rulemaking process.
